It is worth bearing in mind that in 2009, 7 weeks lapsed from the publication of the *final* results (this year that happened on 4 May) until the first councils began electing governors. A formal aspect that delays everything is the publication of the *certified final* results, which is still in the pipeline. IHEC is still working its way through more than 1,000 appeals and is reportedly around half way done with that process. There is then a legal imperative that councils be formed after 15 days – this was violated by several months in some councils in 2009 but it did prompt at least some early movement in some provinces: http://www.historiae.org/Provincialcouncils.asp

It seems a key question remains whether there will be competitive council formations (chiefly, will it be Maliki with minor partners against others, Sadrists & ISCI joining forces, or Maliki opting for either Sadrists or ISCI) or grand-coalition style councils, on the pattern of what Wasit had for a long time previously.

Thank you, but I think if he spoken against it,as you said also “Iraqiyya to the Sadrists supported primarily by ISCI (then SCIRI) and the Kurds” with him in this, the things on the ground more complicated and each of those looks for there specifics (sec), thats why there is struggle between themselves and others in setting things and moving forward to serve the country and the people.

The other things the corruptions that Maliki keep silent and cover up spatially for his Da’awa party members with government, with holding more ministerial post with his PM position all looks he is very restrict to handed to others.

I thinks judging politician not just by what he spoken or against things, its rather than his what he produce by himself to move forward for set things in such away brings other to his party of speech.

I would add, the recent killing and security breaches should the PM hold responsible for it and in any democratic places should he resign.

It seems unfair to blame Maliki for muhasasa (quota-sharing) when he is one of the few Iraqi politicians who have spoken against it with a specific alternative. His concept of a political majority is in theory an explicit rejection of muhasasa. On the other hand, all the others from Iraqiyya to the Sadrists have grown into strong supporters of muhasa, which originally had been supported primarily by ISCI (then SCIRI) and the Kurds.

لكنّ أحزاب المحاصصة الطائفية والقومية التي جعلت من هذه المحاصصات مبدئا للحكم , تريد ان أن تجعل من هذا المبدأ عرفا سياسيا باعتبار منصب الرئيس هو استحقاق كردي ومنصب رئيس الوزراء استحقاق شيعي ومنصب رئيس البرلمان استحقاق سنّي ,

بالرغم من أنّ مجرد القبول بهذا المبدأ , هو ترسيخ لهذه المحاصصات اللعينة التي تسببت في كل المشاكل التي تعترض العملية السياسية والديمقراطية في البلد .

أنباء عن تدهور صحة المالكي وخلاف حول استبدال طالباني – جريدة الاتحاد

داد (الاتحاد) – تداولت بعض المواقع الالكترونية والصحف العراقية أمس خبرا عن إصابة رئيس الوزراء العراقي نوري المالكي بجلطة دماغية نقل على أثرها إلى طهران لتلقي العلاج، فيما أثار طلب رئاسة الادعاء العام من مجلس النواب اختيار بديل لرئيس الجمهورية جلال طالباني، جدالا سياسيا بين مؤيد ومعارض.

ورغم نفي مقربين من المالكي خبر إصابته بالجلطة الدماغية، إلا أن بعض النواب أشاروا إلى أن صحة المالكي متدهورة.

وقال عضو مجلس النواب عن ائتلاف العراقية خالد العلواني “لعل إصابة المالكي بوعكة صحية كما ذكرت القنوات الفضائية، رسالة من الله له كي يغير طريقة إدارته للدولة، فضلا عن تذكيره بالدماء التي سالت في الحويجة والفلوجة التي يتحمل هو مسؤوليتها بالدرجة الأولى، كونه القائد العام للقوات المسلحة”.

ودعا العلواني المالكي إلى مراجعة أجندته السياسية والعمل على تعديلها ، كونها حملت الكثير من الأزمات والمشاكل مع شركائه السياسيين في الدولة، وأن تكون إصابته دافعا له للاستجابة لمطالب المتظاهرين. وحذر النائب جميع السياسيين من التكبر والغرور والتغطرس على الشعب، مبينا أن “المنصب زائل والإنسان نهايته الموت، ولن يبقى من ذكره إلا عمله الصالح”.
وفي شأن متصل قال زعيم التيار الصدري مقتدى الصدر أمس إن “من الضروري اتخاذ الإجراءات اللازمة لتعيين رئيس جمهورية جديد بدل جلال طالباني”. وأضاف “هناك الكثير من المسائل العالقة كملفات الفساد وتأجيل الانتخابات في محافظتي نينوى والأنبار والاتفاق على قانون تجريم البعث، وقضية الاعتداء على المتظاهرين، وغيرها”.

من جانبه أكد الخبير القانوني أحمد العبادي أن القانون يتيح للادعاء العام حق الطلب من رئاسة مجلس النواب اتخاذ الإجراءات القانونية اللازمة بشأن خلو منصب رئيس الجمهورية لغيابه فترة طويلة نتيجة المرض”.

فيما قال النائب عن التحالف الكردستاني فرهاد الأتروشي إنه ليس من اختصاص الادعاء العام دستوريا الطلب من البرلمان اتخاذ الإجراءات القانونية بخصوص خلو منصب رئيس الجمهورية.

كشف مجلس النواب عن إن طلب رئاسة الادعاء العام يوم أمس (الاثنين 13 أيار 2013) باتخاذ الاجراءات القانونية لمعالجة خلو منصب رئيس الجمهورية جلال طالباني سيحفظ داخل اروقة البرلمان لدى هيئة الرئاسة ويبقى معلقا لاشعار اخر.
وقالت اللجنة القانونية البرلمانية ان طلب الادعاء العام لن يدرج على جدول الاعمال للجلسات المقبلة وسيحفظ لدى رئاسة مجلس النواب.
واكد النائب امير الكناني لـ «المستقبل» امس ان هناك قانون ينظر الية الترشيح لرئاسة الجمهورية ويعالج خلو المنصب أقره البرلمان الحالي في العام 2012.
وأضاف الكناني ان القانون يتضمن نصا صريحا يقضي بالغاء كل ما يتعارض مع احكام هذا القانون ما يعني فعليا الغاء وتعطيل اية قوانين اخرى او صلاحيات بموجب القانون الجديد، ملمحا الى وجود سيناريو لطبخة سياسية (بحسب وصفه) سيعمل مجلس النواب على ان لا تاخذ ابعادا اكبر.
وفي اول رد فعل منها عدت كتلة التحالف الكردستاني طلب الادعاء العام من رئيس مجلس النواب اسامة النجيفي اتخاذ اجراءات حول خلو منصب رئيس الجمهورية بانه غير دستوري وليس من صلاحية الادعاء العام.
وقال نائب رئيس كتلة التحالف الكردستاني البرلمانية محسن السعدون لـ «المستقبل» امس ان تعيين بديل لرئيس الجمهورية هو ليس من صلاحية الادعاء العام او مجلس القضاء الاعلى الذين لا يملكان بموجب الدستور اية صلاحيات للتدخل في عمل السلطتين التشريعية والتنفيذية.
بدوره قال رئيس اللجنة القانونية البرلمانية النائب خالد شواني ان طلب الادعاء العام باتخاذ الإجراءات القانونية بخصوص خلو منصب رئيس الجمهورية هو مخالفة دستورية تتعارض مع مبدأ الفصل بين السلطات.
وكانت رئاسة الادعاء العام في العراق دعت يوم أمس رئيس مجلس النواب اسامة النجيفي باتخاذ الاجراءات القانونية بشان خلو منصب رئيس الجمهورية لـفترة طويلة.
وذكرت السلطة القضائية في بيان لها تسلمته «المستقبل نيوز» ان «رئاسة الادعاء العام في العراق طالبت رئيس مجلس النواب اسامة النجيفي باتخاذ الإجراءات القانونية نظراً لمرور فترة طويلة على غياب فخامة رئيس الجمهورية جلال طالباني عن منصبه».

This is why the Iraqi prosecutor general cited the Baath-era law with broad powers to uphold the order of the state (this provision was kept when the law was amended in 2006).

In this case, Khaled Shwani is just a commentator among many. If not so should this matter discussed in special round and the voting will be the judgement in the end to have Talabani replaced

The head of the legal committee in parliament who refutes the call for Talabani to be replaced, Khalid Shwani, is a leading Kurdish MP.

It is interesting that Sadr should support the move to have Talabani replaced.

I find it a little mind-boggling that the judiciary appears to approve of the move, since it has generally been pro-Maliki and since Maliki has generally been pro-Talabani.
